PHOTOGRA.COM strongly believes in protecting our users' information and takes the issue of privacy very seriously. We do not advocate “spamming” (unsolicited emails) and we will not disclose your personal individual information. We collect personal information from you when you join PHOTOGRA.COM. You also may choose to provide personal information at other times, such as when you enter a contest or ask that information be sent to you from one of our advertisers or sponsors. Occasionally however, we will provide aggregated user data to third parties in the form of general user statistics.

When joining PHOTOGRA.COM, you provide personal information as described in the “new member information" section below. As a member of PHOTOGRA.COM, you have unlimited access to your personal information in order to determine its accuracy and make changes if necessary. To access your membership information, simply select "My Accouunt " and choose "change the desired user information".

About the Photogra.com Service

Photogra.com provides functionality enabling our members to upload and store digital photographs on our web servers. We also provide the functionality for uploaded images to be viewed using online photo-albums.

Photos on our site may be viewed in three ways:

Members may choose to designate their photos to be displayed in our "Public albums" section. Only the member that uploaded the photos may decide to display their images in our public area. The member may also choose to revoke their photos from the public area at any time, and/or to delete them from our system, or to designate them for only private viewing by their invited guests.
Members may choose to maintain their images for private viewing only. This is the default setting for all online photo albums. Members are provided with functionality for inviting guests to view their private albums, and these guests are only provided access once signed on to our system, and access rights to view the specified photos are confirmed by our programs. The member may also choose at any time to revoke individual viewing privileges to any or all of their photo albums for any previously invited guest viewer or viewers. Through our sharing and "invitation only" system, we provide our members with granular control over deciding which individuals that they have selected for viewing of their photos. These individuals must also be members of our service to view private albums.
Members and their designated guests may choose to send their photos to individuals that may, or may not be members of our service in the form of greeting cards, email attachments, photo-re-prints or other gift type products


Information and photographs uploaded to our site are stored on secure, password protected computers located in a maximum security data center. Access to the data center is monitored by security cameras twenty-four hours a day, and only authorized persons are allowed entry to the facility, and access to the servers.

All e-commerce programs used for purchasing products on our site offer the SSL (Secure Sockets Layer) protocol for encrypting sensitive information transmitted from the user's web browser.

Our customer feedback form is used exclusively as a customer service tool. The information received, questions asked, and responses provided are maintained within the privacy guidelines consistent with this policy. PHOTOGRA.COM is committed to protecting your privacy and we will not disclose this information to third parties as outlined below. If you opted to receive email communications from us regarding our products and services, we will also provide you information on how to unsubscribe from future emails.

New Member Information

If you choose to join PHOTOGRA.COM, we do require that you provide us with certain current and accurate personal identifying information, such as your name, email address, gender, ZIP code and year of birth.PHOTOGRA.COM is committed to protecting your privacy and will not sell or rent your personal information to any third party.

When you register as a new member of PHOTOGRA.COM, you are offered the option to receive email messages from us. These messages may include updates regarding our site's services, features and other information meant to enhance your experience on our site. You are also offered the option to receive mailings featuring our sponsors' products or services.It is our goal to provide you with information relevant to your interaction with our site and you may unsubscribe from these services at any time.

Choice/Opt-out

Our users are given the opportunity to 'opt-out' of having their information used for purposes not directly related to our site at the point where we ask for information. For example, our registration form has an 'opt-out' mechanism for users who provide personal information when becoming a member, but don't want any marketing material, and can keep their email address off of our lists.

Users who no longer wish to receive our newsletter and promotional communications may opt-out of receiving these communications by replying with the word "unsubscribe" in the subject line in the email, or email our Customer Service

Correcting/Updating/Deleting/Deactivating Personal Information

If a user's personally identifiable information changes (such as zip code, phone, email or postal address), or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate users' personally identifiable information. This can be done on our Settings page, or by emailing our Customer Service.

Users of our site are always notified when their information is being collected by any outside parties. We do this so our users can make an informed choice as to whether they should proceed with services that require an outside party, or not.

Sharing

PHOTOGRA.COM will not disclose your personal information to a third party unless we are required to do so by law or we in good faith believe that such action is necessary to (1) comply with the law or with legal process; (2) protect and defend our rights and property; (3) protect against misuse or unauthorized use of PHOTOGRA.COM or (4) protect the personal safety or property of PHOTOGRA.COM members or the public. Should you choose to provide false us with information or attempt to pose as someone else-- information about you as well as your computer's IP address -- may be disclosed as part of any investigation into your actions.

PHOTOGRA.COM does share aggregated user statistics, with third parties for business purposes. An example of this would be that you might represent a part of a percentage within a demographics report shown to advertisers and sponsors of our site. We use an outside shipping company to ship orders, and a credit card processing company to bill users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes.

However, please understand that you can share your own images with others via the Photogra site, which we can only assist in controlling. Please be aware of who you choose to share your images with and what personally identifiable information might be contained within those images that you post publicly.

Cookies

In order to continually improve your experience on our site, PHOTOGRA.COM may place a “cookie” on your computer's hard drive. “Cookies” allow us to compile aggregate information about which areas of our site are visited most frequently and to remember your personalized site settings. The traffic information attained may be used to enhance the content of our site. By verifying that you are a member, the cookie makes it more convenient for you to use our site.

If you've set your browser to reject cookies, you can still use our site, but only in a limited capacity. You can also set your browser to warn you before accepting cookies. If you do, you will receive a warning message each time our site attempts to place a cookie on your hard drive.

Like most standard web site servers we use log files. This includes IP (internet protocol) addresses, browser type, ISP (internet service provider), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user's movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information.

Contests and Promotions

On various occasions, PHOTOGRA.COM sponsors contests, surveys or promotions or allows other companies to sponsor contests or promotions on our site. In order to enter a contest or promotion, you would be asked to provide personally identifiable information. For all contests and promotions sponsored by PHOTOGRA.COM, the information you submit will be treated the same way we would treat your new member information.

However, if a promotion is sponsored by a third party it will clearly indicate who is collecting the personal information and you will be given an opportunity to volunteer your information where you will have a choice whether to disclose your personally identifiable information to third parties. These third parties may have their own policies for handling personal information, and information you submit will be subject to those policies. Although PHOTOGRA.COM encourages third parties to adhere to appropriate privacy standards and policies, we are not responsible for the actions or policies of such parties.

Our Sponsors and Business Partners

Our sponsors, from time to time, offer you the opportunity to sign up for their services or information, such as newsletters or promotions. In these instances, we will clearly inform you about exactly who is collecting what personally identifiable information requested by the sponsor, and we will ask you to opt-in and give your permission to release your information to the sponsor prior to disclosing your personal information. If you consent, PHOTOGRA.COM will transfer your information to the sponsor. Once your information has been transferred to the sponsor, PHOTOGRA.COM is not responsible for its use. The sponsor's use of the information is governed by the sponsor's privacy policy. While we encourage our third party sponsors to adhere to appropriate privacy standards, we are not responsible for the actions or policies of our sponsors.

Privacy Changes

Because PHOTOGRA.COM strongly believes in protecting our users' personal information, you have our assurance that you will be notified of any changes made in our privacy practices. A notice of change will be posted on our site so that our users are made aware of any changes made. If we are going to use your personally identifiable information in a manner different from that stated at the time of collection we will notify you via email. You will have a choice as to whether or not we use your information in this different manner. However, if you have opted out of all communication with the site, or deleted/deactivated your account, then you will not be contacted, nor will your personal information be used in this new manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on our web site notifying users of the change. In some cases where we post a notice we will also email users, who have opted to receive communications from us, notifying them of the changes in our privacy practices.
